In his defense at the sentencing hearing held at the Bolu 5th Criminal Court of First Instance, Özcan argued that the opinion on the merits of the case was incomplete, stating that the alleged actions could not be considered as the execution of the crime, and requested his acquittal.

The court panel acquitted Tanju Özcan of the "hate and discrimination" charges following the trial. The case was opened based on complaints filed after Özcan's decisions during his time as mayor to cut social aid to refugees, increase water tariffs, and introduce marriage fees for foreign nationals.

On the other hand, it was reported that Özcan's detention continues within the scope of a separate investigation into "extortion through coercion."
